File Swapping Goes Marketing

Was just watching CNBC and the music industry is now really showing how warped they are. Some companies are now using a company that watches what is being downloaded and using it for marketing. Seems they complain yet they are actually trying to make use of the P2P programs to see what users want. Wish they'd make up their minds.

Should be some kind of double-standard law-suit brewing there that would stop them from being able to sue file swappers. (Not sure if that came out right, but hopefully you get my point).

Well the ones using the programs for marketing tools instead of legal tools are the smart ones. All the RIAA is doing is alienating a whole generation if not more of potential customers where as the groups using it for marketing are smart because they are learning what makes their customers tick so they can put out better music. That's the smart thing the RIAA may sue a lot of people and it will be the RIAA who unltimately gets the worst end of that deal when those users they sue never come back to them and when those watching this circus don't come back as well.

The one thing I don't understand is how the RIAA can access peoples computers and this would stand up in court?

Isn't this the same has the police searching your house without a search warrent? Or even a company wire tapping your home phone and using information from your call against you.

it is the judge can't constitutionally order a supenoa (spelling?) to force companies to open their customers private records up. If the RIAA has info on certain customers let them issue the warrants to the customers because they know full well they can't get the warrants without probabl cause and without access to our ISP records they can't get probabl cause enough so to request a search warrant for specific individuals. This is why I get so uppetity with government because this is just an abuse of government doing what it wants.

Like have you heard some retarded judge in Oklahoma sided with telemarketers and has at leats for now put the national do not call list on hold. Seems the telemarketers were crying they would lose like 50 Bil. So what they claim they have this right to harass us and this idiot judge actually sided with them.

As I was telling another forum I think it's time we remind judges that they have to serve in good behavior otherwise can be thrown off the bench. Top many have forgotten this simple FACT!

most of the isp's are buckling under the THREAT of legal action. Too costly to defend themselves?
SBC finally did something good and said NO, they are supposedly going to task on it.
That could prevent a precedent from being set that implies ISP's must give info without due course of law.
SBC if they follow thru should be applauded. (Cingular, part of sbc still SUCKS tho.)

Their bound for legal action from all their users if they continue. They do not have to comply with court orders which violate the rights of their users and to do so opens them up to law suits.
